These Terms of Service ("Terms") govern your use of herhearth.com (the "Site") and any digital courses, lessons, downloads, videos and related materials (together, "Courses") offered by Her Hearth ("Her Hearth," "we," "us" or "our"), based in Baldwin County, Alabama. By using the Site or purchasing a Course, you agree to these Terms, our Privacy Policy, our Refund Policy and our Health Disclaimer. If you don't agree, please don't use the Site.
1. Eligibility
You must be at least 18 years old, and able to form a binding contract, to purchase Courses or create an account.
2. Educational content — not medical advice
3. Your account
You're responsible for keeping your login details confidential and for all activity under your account. Please give us accurate information and let us know right away at [email protected] if you suspect unauthorized use.
4. Purchases and pricing
- Prices are shown in U.S. dollars and may change at any time, but a change won't affect an order you've already placed.
- Payment is processed by a third-party payment processor at checkout. By submitting payment, you confirm you're authorized to use the payment method.
- You're responsible for any applicable taxes. We collect sales tax where required.
- We may refuse or cancel an order — for example, for a pricing error or suspected fraud — and will refund any payment for a cancelled order.
- Refunds are handled under our Refund Policy.
5. Your license to use Courses
When you buy a Course, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use it for your own personal, non-commercial use, for as long as we offer the Course or as otherwise stated at purchase. You may not:
- share your login or let anyone else access your Courses;
- copy, record, download (except where we provide a download), reproduce, resell, distribute, publicly display or create derivative works from Course materials;
- use Course materials to teach, coach or train others, or for any commercial purpose; or
- use automated tools to scrape or copy content from the Site.
We may suspend or revoke access, without refund, if you violate these Terms.
6. Intellectual property
The Site and all Courses — including text, video, audio, graphics, images, worksheets, logos and the Her Hearth name — are owned by Her Hearth or its licensors and protected by U.S. and international copyright, trademark and other laws. Except for the license above, no rights are granted to you.
7. Acceptable use
You agree not to misuse the Site — for example, by interfering with its operation, attempting to gain unauthorized access, uploading malicious code, or posting anything unlawful, harassing or infringing in any community or comment area we provide.
8. Changes to Courses and the Site
We may update, improve or change Course content, and we may modify or discontinue parts of the Site. If we permanently discontinue a Course you purchased within the last 12 months, we will make reasonable efforts to give you notice and continued access for a reasonable period, or a replacement or partial refund.
9. Third-party services
The Site may use or link to third-party services (such as payment processors or video hosts). We're not responsible for third-party services, and your use of them may be subject to their own terms.
10. Disclaimer of warranties
THE SITE AND COURSES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, HER HEARTH DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT GUARANTEE ANY PARTICULAR HEALTH OUTCOME OR RESULT, OR THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, HER HEARTH AND ITS OWNERS, EMPLOYEES, CONTRACTORS AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR ANY PERSONAL INJURY OR HEALTH-RELATED LOSS ARISING FROM YOUR RELIANCE ON COURSE CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE OR COURSES WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE COURSE GIVING RISE TO THE CLAIM IN THE 12 MONTHS BEFORE THE CLAIM AROSE. Some jurisdictions don't allow certain limitations, so some of these may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless Her Hearth and its owners, employees and contractors from any claims, losses and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or misuse of the Site or Courses.
13. Governing law and disputes
These Terms are governed by the laws of the State of Alabama, without regard to its conflict-of-law rules. Before filing any claim, you agree to first contact us at [email protected] and try in good faith to resolve the dispute informally for at least 30 days. If it isn't resolved, you and Her Hearth agree that any lawsuit will be brought exclusively in the state courts located in Baldwin County, Alabama, or the United States District Court for the Southern District of Alabama, and you consent to the personal jurisdiction of those courts. Either party may bring an individual claim in small claims court where it qualifies.
14. Changes to these Terms
We may update these Terms from time to time. The updated version will be posted here with a new "Last updated" date. Continuing to use the Site after changes take effect means you accept the updated Terms. Changes won't apply retroactively to purchases you've already made.
15. General
These Terms, together with the policies referenced above, are the entire agreement between you and Her Hearth about the Site and Courses. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision isn't a waiver. You may not assign these Terms; we may assign them in connection with a business transfer.
